CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL TERMS:

  1. By placing an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract presented to you.

  2. Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (OG: 27.11.2014/29188) and other applicable laws concerning the sale and delivery of the purchased product.

  3. Shipping costs, which are the product shipment expenses, shall be paid by the buyers.

  4. Each product purchased shall be delivered to the person and/or organization at the address indicated by the buyer within 30 days, provided that the legal period of 30 days is not exceeded. If the product is not delivered within this period, the buyers may terminate the contract.

  5. The purchased product must be delivered complete and in accordance with the specifications specified in the order, along with documents such as the warranty certificate and user manual, if any.

  6. In the event that the sale of the purchased product becomes impossible, the seller must inform the buyer in writing within 3 days from the date it becomes aware of the situation. The total price must also be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

  1. If the buyer fails to pay the price of the purchased product or cancels the payment in the bank records, the seller's obligation to deliver the product shall end.

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARDS:

  1. If it is determined after the product has been delivered that the credit card used by the buyer for payment was used unlawfully by unauthorized persons, and if the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with shipping costs borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED WITHIN THE EXPECTED TIME DUE TO UNFORESEEN CIRCUMSTANCES:

  1. If unforeseen circumstances arise that the seller could not have anticipated and the product cannot be delivered on time, the situation will be notified to the buyer. The buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of delivery until the obstacle is removed. If the buyer cancels the order, the payment made by cash will be refunded to them in cash within 14 days from the date of cancellation. If the buyer made the payment by credit card and cancels the order, the product amount will be refunded to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the buyer’s account.

THE BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The buyer will inspect the goods/services subject to the contract before receiving them; they will not receive damaged and defective goods/services such as crushed, broken, torn packaging from the cargo company. The delivered goods/services will be considered undamaged and intact. The BUYER must carefully protect the goods/services after delivery. If the right of withdrawal is to be used, the goods/services should not be used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

  1. The BUYER may exercise the right to withdraw from the contract by refusing the goods, without assuming any legal or criminal liability and without giving any reason, within 14 (fourteen) days from the date of delivery of the purchased product to the BUYER or to the person/organization at the address indicated. The notification of the exercise of the right of withdrawal must be made through the communication information below.

PERIOD OF THE RIGHT OF WITHDRAWAL:

  1. If the purchased item is a service, this 14-day period begins from the date of the contract. The right of withdrawal cannot be exercised for service contracts where the provision of the service has started with the consumer's approval before the end of the right of withdrawal period. The buyer is provided with information on the right of withdrawal in the Distance Contracts and Cancellation Conditions, and the buyer places the order knowing the withdrawal conditions.

  2. The costs arising from the exercise of the right of withdrawal are borne by the SELLER.

  3. To exercise the right of withdrawal, the notification must be sent to the SELLER in writing or by the method indicated by the SELLER within the 14 (fourteen) day period, by registered mail with return receipt requested, fax, or email. The product must not have been used within the framework of the provisions of the "Products for Which the Right of Withdrawal Cannot Be Used" set forth in this contract.

USE OF THE RIGHT OF WITHDRAWAL:

  1. The invoice of the product delivered to the 3rd party or the BUYER (if the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution when returning. The return cannot be completed without issuing the RETURN INVOICE for orders invoiced to institutions).

  2. The return form, the products to be returned must be delivered complete and undamaged with their box, packaging, and standard accessories, if any.

RETURN CONDITIONS:

  1. The SELLER is obliged to return the total price and the documents that put the BUYER under debt to the BUYER within 10 days from the receipt of the withdrawal notification, and to take back the goods within 20 days.

  2. If there is a decrease in the value of the goods due to the BUYER's fault or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages at the rate of their fault. However, the BUYER is not responsible for the changes and deteriorations that occur due to the proper use of the goods or products within the right of withdrawal period.

  3. If the value of the campaign limit set by the SELLER is reduced due to the exercise of the right of withdrawal, the amount of the discount used within the scope of the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

  1. Products that are prepared in accordance with the BUYER's wishes or clearly their personal needs, and that are not suitable for return, underwear bottoms, swimwear and bikini bottoms, make-up products, single-use products, goods that are in danger of spoiling quickly or may expire, products that are not suitable for return in terms of health and hygiene if their packaging is opened by the BUYER after delivery, products that are mixed with other products after delivery and cannot be separated by their nature, periodicals such as newspapers and magazines, other than those provided under the subscription agreement, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if their packaging has been opened by the BUYER, cannot be returned as per the Regulation. In addition, the right of withdrawal cannot be exercised for services that have started to be performed with the consumer's approval before the end of the right of withdrawal period, as per the Regulation.

  2. Cosmetic and personal care products, underwear products, swimwear, bikinis, books, reproducible software and programs, DVDs, VCDs, CDs, and tapes, and stationery consumables (toner, cartridge, ribbon, etc.) must be unopened, untested, undamaged, and unused in order to be returned.

  3. According to the distance contracts regulation, the products for which the right of withdrawal cannot be exercised are as follows:

Contracts for goods prepared in line with the consumer's requests or personal needs.

Contracts for the delivery of perishable goods or goods whose expiry date may pass.

Contracts for goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; therefore, the return is not suitable in terms of health and hygiene.

Contracts for goods that are mixed with other products after delivery and cannot be separated by their nature.

Contracts for books, digital content, and computer consumables offered in material form, if protective elements such as packaging, tape, seal, package have been opened by the consumer.

Contracts for accommodation, goods transportation, car rental, food and beverage supply, and contracts for the use of leisure time for entertainment or rest, which must be made on a certain date or period.

Contracts for services performed instantly in electronic environment or for intangible goods delivered instantly to the consumer.

DEFAULT AND LEGAL CONSEQUENCES

  1. The BUYER accepts, declares, and undertakes that if they make the payment transactions by credit card and fall into default, they will pay interest within the framework of the credit card agreement with the cardholder bank and be liable to the bank. In this case, the relevant bank may take legal action; the BUYER may have to pay the costs and attorney fees, and in any case, the BUYER accepts that if they default on their debt, they will compensate the SELLER's loss and damage due to the delayed performance of the debt.
